The U.S. Equal Pay Act of 1963 forbids sex-based wage discrimination. Ohio’s Equal Pay Act contains the same prohibition.
This means that men and women who work for the same employer and perform jobs that are substantially the same in content, if not title, must be paid the same.
Salary, overtime, bonuses, stock options, profit sharing and bonus plans, life insurance, vacation and holiday pay, cleaning or gas allowances, hotel accommodations, travel expense reimbursement and benefits are all covered by this law.
The Equal Pay Act is not violated if unequal pay to male and female employees is due to: a) a seniority system; b) a merit system; c) a system which measures earnings by quantity or quality of production.
